Information on Telecommunication Towers

  ORC 519.211 Limits on township zoning power - telecommunications towers.

Section 519.211 of the Ohio Revised Code places limitations on the Township’s power to regulate telecommunication towers.   The State of Ohio considers telecommunication towers a public utility and grants them exemptions from local zoning.  

Telecommunication towers are exempt from local zoning in all zoning districts except residential.  In Miami Township telecommunication towers are exempt in all districts except the “R-1” and “R-2” Single Family Districts; the “R-3” and “R-4” Multi-Family Districts; the “T” Mobile Home Park District and the “R-PUD” Planned Unit Development District.
